TOWN OF WAKAW
BYLAW #6/96

A Bylaw of the Town of Wakaw to provide for the implementation and provisions of a curfew.

The Council of the Town of Wakaw, in the Province of Saskatchewan, enacts as follows:

PART 1  SHORT TITLE AND PURPOSE:

(a)          This Bylaw shall be called the "Curfew Bylaw".

(b)          The purpose of this Bylaw is to regulate the time during which minors are allowed to be in public places without the supervision of a parent or guardian and to make parents or guardians responsible for their child.

PART 2  INTERPRETATION:

(a)          Child  means a person who is under the age of 16 (sixteen) years.

(b)          Public Place  includes any place to which the public have access as of right or by invitation, express or implied.

PART 3  INFRACTIONS:

(a)          No child shall be in a public place in the Town of Wakaw, Saskatchewan, between the hours of 11:00 o'clock p.m. and 6:00 o'clock a.m. of any day without the proper guardianship or supervision of a parent or guardian.

(b)          A child found in a public place after the time set out in Section 3(a) may be warned to go home by any peace officer, and if after such warning the child is found loitering in a public place, the child may be taken by the peace officer to the child's home.

PART 4  PENALTIES:

(a)          Any parent or guardian who permits his child or ward to contravene this bylaw, is guilty of an offense and liable on summary conviction to the penalties specified in the General Penalty Bylaw of the Town of Wakaw, Saskatchewan.

(b)          Any child who contravenes this bylaw is guilty of an offense and liable on summary conviction to the penalty specified in the General Penalty Bylaw of the Town of Wakaw.

(c)          Upon being served with a Notice of Violation, a violator of this Bylaw may, during regular office hours, voluntarily pay the penalty as stated below to the clerk at the municipal office, and upon payment as so provided, that person shall not be liable to prosecution of the offense.

(d)          The Notice of Violation shall be in Form "1" Appendix "A", attached to and forming part of this bylaw.

PART 5  REPEAL:

(a)          Bylaw 9/66 is hereby repealed.

PART 6  EFFECT:

(a)          This Bylaw shall come into force and take effect on October 1, 1996.
